Terms & Conditions

Thank you for choosing Sweet Tooth Baker Sydney (“STB Sydney”, “we”, “us”) to create your cookies (“the Order”). By placing an order through our website, you agree to be bound by the following Terms & Conditions.
1. Placing & Confirming Your Order
1.1 All orders placed through our website require full payment upfront at the time of checkout. An order is not confirmed until payment has been successfully received.
1.2 Once payment is received, your order date is reserved and we may decline other work for that date. You acknowledge that we suffer loss by reserving production time and capacity for your order.
2. Pricing & Invoices
2.1 Your order confirmation will include:

The cookies selected
-
The collection or delivery date
-
The total price paid
2.2 All prices are based on costs, availability, and specifications current at the time the order is placed.
2.3 Subject to your rights under the Australian Consumer Law, we reserve the right to vary pricing where:

Changes are requested after purchase
-
Ingredient, packaging, or supplier costs increase
-
Additional labour or materials are required
2.4 Any additional charges must be paid in full before the order is prepared.
3. Changes to Your Order
3.1 Requests to change your order must be made at least 5 days before the scheduled collection or delivery date.
3.2 All change requests are subject to availability and approval. We are not obligated to accommodate changes.
3.3 Where changes are approved, additional charges may apply and must be paid within 48 hours of invoicing.
4. Cancellation & Postponement
4.1 Cancellation by You
4.1.1 You may cancel your order by notifying us in writing. The following applies:

Cancellations made 5 days or more before the collection or delivery date may receive a refund, excluding any non-recoverable costs already incurred

Cancellations made within 5 days of the collection or delivery date are non-refundable
4.2 Postponement
4.2.1 We will use reasonable endeavours to accommodate postponement requests where possible.
4.2.2 The following conditions apply:

A minimum of 5 days’ notice is required

Only one postponement is permitted per order
-
The new date must be within 12 months of the original date
4.2.3 Where these conditions are not met, the order will be treated as cancelled.
5. Our Right to Terminate or Refuse Service
5.1 We reserve the right to terminate an order or withdraw our goods and services where:

Payment is not made when due
-
There is non-cooperation or unreasonable conduct
-
Delivery or collection arrangements change without agreement
-
Appointments are missed or instructions are unclear
5.2 Where termination occurs, you will be responsible for all costs incurred up to the date of termination.
6. Design, Size & Colour Variations
6.1 Cookies are handmade and decorative baking is an artistic process. While we strive to meet agreed designs, minor variations may occur.
6.2 Sizes provided are a guide only. Variations may occur during baking and decorating.
6.3 Colour matching is not exact. Colours may vary due to:

Food-grade dye limitations

Differences in substrates
-
Screen and device displays
6.4 We do not guarantee exact replication of reference images, sketches, or digital mock-ups.
7. Collection & Delivery
7.1 Collection or delivery preferences must be selected at checkout.
7.2 Where collection is selected:

You or your representative are responsible for the safe transport of the order
-
We are not liable for damage once the order leaves our possession
7.3 Where delivery is selected, delivery details will be arranged with you. We are not responsible for delays caused by factors outside our control.
7.4 Cookies should be stored in a cool, dry place away from heat and sunlight and must not be refrigerated. We are not liable for damage caused by incorrect storage.
8. Allergies & Dietary Disclaimer
8.1 We are not an allergy-free bakery. Our products may contain or come into contact with allergens including but not limited to gluten, dairy, eggs, nuts, and soy.
8.2 It is your responsibility to notify us of any allergies prior to placing an order.
8.3 To the fullest extent permitted by law, we accept no liability for allergic reactions or adverse effects.
9. Photography & Intellectual Property
9.1 By placing an order, you grant STB Sydney permission to photograph your order and use images for marketing, advertising, and promotional purposes.
9.2 Where images are supplied by your photographer, you warrant that you have permission from the copyright holder for their use.
9.3 All creative work must be credited to Sweet Tooth Baker Sydney where published.
10. Liability & Indemnity
10.1 To the fullest extent permitted by law, our liability for any claim relating to the supply of goods or services is limited, at our discretion, to:

Replacement of the goods

Repair of the goods
-
Refund or credit
10.2 We are not liable for indirect, incidental, or consequential loss except where required under the Australian Consumer Law.
10.3 You agree to indemnify and hold harmless STB Sydney from any claims arising from misuse, mishandling, or consumption of our products.
11. Force Majeure
11.1 We are not liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, government restrictions, power outages, or supplier disruptions.
11.2 Where fulfilment becomes impossible due to such events, a store credit valid for 12 months will be issued. Credits are non-transferable.
12. Governing Law
These Terms & Conditions are governed exclusively by the laws of New South Wales, Australia.
